These Terms of Use (“Terms”) form an agreement between you and Financial Confidence, an Indiana sole proprietorship, operating as Financial Confidence (“Financial Confidence,” “we,” “us,” or “our”). These Terms govern your access to and use of financialconfidence.net, including its pages, accounts, lessons, courses, communications, tools, features, and content (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms and acknowledge our Privacy Policy and Disclaimer. If you do not agree, do not access or use the Site.
If you create an account, purchase a product or service, submit information, or use another feature requiring affirmative acceptance, you agree to these Terms by selecting the checkbox or button presented with the applicable links. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes both you and the organization.
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Site. The Site is not directed to minors, and minors may not create accounts or use account-based or interactive features.
If we learn that an account belongs to a minor, we may suspend or close it and handle associated personal information in accordance with our Privacy Policy and applicable law.
The Site provides general educational and informational content. It does not provide individualized financial, investment, legal, tax, accounting, insurance, real estate, lending, credit-repair, or other professional advice and does not create a professional or fiduciary relationship. Additional details and important risk disclosures appear in our Disclaimer, which is incorporated into these Terms.
Some Tools, such as the Credit Improvement Roadmap, help you organize your own credit information and prepare draft letters or other correspondence for your own use. Any such letter or template is a draft for your review only. You are solely responsible for reviewing, completing, deciding whether to send, and sending any letter or correspondence yourself. Financial Confidence does not submit disputes or other correspondence to any credit bureau, creditor, furnisher, or collector on your behalf, does not act as your representative or agent in any dispute, and does not determine whether information on your credit report is legally required to be corrected or removed.
Anyone can read the Blog and use our Tools without an account. Creating a free account is required only to access Courses (lessons and final exams) and to track your progress and earn certificates. To create an account, you provide your first name, last name, email address, and a password. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account to the extent permitted by law.
You may not share credentials, impersonate another person, create an account using false information, create multiple accounts to re-take an exam you have already passed for the purpose of misrepresenting your results, or access another user’s account without permission. Notify us promptly at hello@financialconfidence.net if you believe your account or credentials have been compromised. We may require reasonable verification before restoring access or acting on an account request. See our Privacy Policy for how we store and protect account information.
Course exams and certificates. Final exams are provided so you can test what you have learned; a certificate of completion is issued when you pass an exam at the required score. Certificates reflect completion of free educational content and are not a professional license, credential, or accreditation, consistent with our Disclaimer. You agree not to copy, publish, share, or distribute exam questions or answers, look up or attempt to obtain answers from any source other than the lessons themselves, or otherwise attempt to circumvent exam grading. We may revoke a certificate obtained through fraud, a violation of this section, or a materially false statement made at sign-up.
Subject to these Terms, Financial Confidence grants you a limited, personal, nonexclusive, nontransferable, revocable license to access and use the Site for your own lawful, noncommercial educational purposes.

The Site and its content, including text, lessons, course structure, graphics, logos, designs, software, and compilations, are owned by or licensed to Financial Confidence and are protected by intellectual-property laws. “Financial Confidence” and associated branding may be trademarks or service marks of Financial Confidence or its licensors.
These Terms do not transfer ownership of any intellectual property to you. You may print or download a reasonable number of pages for your personal, noncommercial educational use, provided you retain all notices and do not modify or misrepresent the content.
If the Site allows you to submit comments, questions, reviews, testimonials, files, or other material (“User Content”), you retain any ownership rights you have in that material. You grant Financial Confidence a worldwide, nonexclusive, royalty-free license to host, store, reproduce, and display User Content solely as reasonably necessary to operate, secure, improve, and provide the Site and to fulfill the purpose for which you submitted it.
We will not publicly use your name, image, testimonial, or personal story for advertising or promotional purposes without any consent required by applicable law.
You represent that you have the rights needed to submit User Content and that it does not violate any law or another person’s rights. Do not submit Social Security numbers, passwords, account credentials, full payment-card data, or unnecessary sensitive financial or personal information through comments, ordinary email, or public-facing features.
If you voluntarily provide ideas or feedback about the Site, we may use them without restriction or compensation, provided that we do not publicly identify you in connection with the feedback without permission.
The Site does not currently sell products, subscriptions, or paid services. If that changes, applicable pricing, payment, renewal, cancellation, and refund terms will be presented before purchase, and these Terms will be updated as appropriate.
The Site may contain links to or integrations with third-party websites, products, data, or services. We do not control those third parties, and their terms and privacy practices govern your use of their offerings. A link or reference does not necessarily mean that Financial Confidence endorses or guarantees the third party.
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the Site, you acknowledge that you have reviewed the Privacy Policy. If these Terms conflict with the Privacy Policy concerning our handling of personal information, the Privacy Policy controls to the extent of that conflict.
If you believe material on the Site infringes your copyright, send a notice to hello@financialconfidence.net containing sufficient information to identify the copyrighted work, the allegedly infringing material and its location, your contact information, a statement of your good-faith belief that the use is unauthorized, a statement under penalty of perjury that the information is accurate and that you are authorized to act, and your physical or electronic signature.
If the Site hosts material submitted by users, consult counsel about designating and registering a DMCA agent and adding a complete repeat-infringer policy.
You may stop using the Site at any time. You may request account closure using the method described on the Site or by contacting hello@financialconfidence.net.
We may suspend or terminate access when we reasonably believe you have materially violated these Terms, created security or legal risk, used the Site fraudulently or unlawfully, or when suspension is necessary to protect the Site or others. Where reasonably practicable, we will provide notice and an opportunity to address the issue. We may also discontinue all or part of the Site, subject to any obligations that apply to paid offerings.
Provisions that by their nature should survive termination, including intellectual-property, warranty, liability, indemnification, dispute, and miscellaneous provisions, will survive.
We may modify, update, suspend, or discontinue Site features from time to time. We do not guarantee that the Site will always be available, uninterrupted, secure, or error-free. This section does not limit any contractual obligation relating to a paid product or service or any right that cannot lawfully be waived.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” FINANCIAL CONFIDENCE DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION OR RESULT WILL BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR YOUR CIRCUMSTANCES.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINANCIAL CONFIDENCE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST INCOME, LOST DATA, MISSED OPPORTUNITIES, DAMAGE TO CREDIT, OR OTHER FINANCIAL LOSS, ARISING OUT OF OR RELATING TO THE SITE, ITS CONTENT, OR YOUR USE OF OR INABILITY TO USE THEM, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF FINANCIAL CONFIDENCE AND THE PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO FINANCIAL CONFIDENCE FOR THE RELEVANT SITE PRODUCT OR SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100.
These limitations apply regardless of the legal theory asserted and even if a remedy fails of its essential purpose. They do not apply to fraud, willful misconduct, gross negligence where it cannot lawfully be limited, or any liability, right, or remedy that applicable law does not permit the parties to exclude or limit.
To the extent permitted by law, you agree to indemnify and hold harmless Financial Confidence and its owners, officers, employees, contractors, and affiliates from third-party claims, damages, liabilities, judgments, and reasonable costs arising from your unlawful misuse of the Site, your material violation of these Terms, or your infringement or violation of another person’s rights.
This section does not require you to indemnify any party for its own fraud, willful misconduct, or other conduct for which indemnification may not lawfully be required. We will provide reasonable notice of an indemnified claim and will not agree to a settlement that admits fault or imposes a nonmonetary obligation on you without your consent, which will not be unreasonably withheld.
Except where applicable law provides otherwise, these Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules.
Any court proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the state courts located in Hendricks County, Indiana, or the United States District Court serving that county, and you and Financial Confidence consent to the personal jurisdiction of those courts. Nothing in these Terms deprives a consumer of a protection or right that cannot lawfully be waived, including any right to bring an eligible matter in small-claims court.
We may update these Terms to reflect changes to the Site, our practices, or applicable law. We will post the updated Terms and revise the “Last updated” date. When required by law, or when a change materially reduces your rights or increases your obligations, we will provide additional notice and request renewed consent where legally required.
Changes apply prospectively from their stated effective date. Your continued use of the Site after the effective date constitutes acceptance to the extent permitted by law. If you do not agree to updated Terms, you must stop using the Site and may close your account.
You agree that notices and other communications relating to the Site may be provided electronically, including by email, through your account, or by posting on the Site, subject to applicable law. You are responsible for keeping your account email address current. Marketing communications are governed by the consent and unsubscribe choices stated in those communications and our Privacy Policy.
These Terms, together with the Privacy Policy, Disclaimer, and any additional terms presented for a specific feature or purchase, constitute the entire agreement between you and Financial Confidence concerning the Site. If additional terms conflict with these Terms, the additional terms control only for the applicable feature or purchase.
If any provision is found invalid or unenforceable, it will be limited or modified to the minimum extent necessary, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law, subject to applicable law. Headings are for convenience only.
